1. Introduction

The offer and sale of products on this website is governed by these General Conditions of Sale.

1.2 By using the  solosmedia.net (hereinafter also referred to as the “website”), users accept these General Conditions of Sale; for this reason e Musicians & Producers srls all users to read them in advance.

1.3 These General Conditions of Sale may, at any time, be updated and / or modified by Musicians & Producers srls; the changes and updates will be binding from the moment of their publication in this section to which users are invited to access regularly to verify the publication of the most recent and updated General Conditions of Sale of solosmedia.net.

1.4In the event that the user does not agree, in whole or in part, with these General Conditions, please refrain from accessing and using the website.

1.6 In order to validly conclude this contract, the Customer must have reached the age of majority in his country of residence and the legal capacity to act, which he declares, under his own responsibility, to possess.

2. The contract

2.1. The characteristics and the price (including VAT) of the Product for sale on solosmedia are shown on the related page. Availability, characteristics, quantity and price of each Product may vary over time.

2.2. To purchase the Products, the buyer must complete and send the order form in electronic format, following the instructions contained in solosmedia.net, as detailed below in point 4.

2.3. By sending the order, which has the value of a contractual proposal, the Customer acknowledges and declares that he has read all the information provided during the purchase procedure and that he fully accepts the Terms and Conditions of Sale, which are an integral part of the order itself.

2.4. The contract stipulated between the buyer and Musicians & Producers srls must be considered concluded with the acceptance of the order by the latter. Acceptance is communicated to the buyer through an order confirmation email, to the email address he will have provided during the purchase.
This email contains: a reference to the applicable General Terms and Conditions of Sale; the order number; shipping data (only for physical and non-virtual orders); the Product or Products purchased and the total price, including shipping costs only and exclusively for physical products (books, CDs, vinyls, DVDs)

2.5. Musicians & Producers srls reserves the right to modify these Terms and Conditions at any time, at its discretion and in compliance with current legislation.

3. The product

3.1. The characteristics of the Product are those indicated in the Product sheet which you can find directly on solosmedia.net

3.2.

The visual representation of the Product on the Site, where available, normally corresponds to the Product itself. The image of the Product is purely indicative and therefore may not be perfectly representative.
In this case, the description of the Product sheet is always valid.

3.3. The Product is sold with the characteristics described in solosmedia.net at the time the order is placed by the buyer.

4. How to buy on solosmedia.net

4.1First of all, the display of the products on the solosmedia.net site constitutes a simple invitation to offer.

4.2 PTo proceed with the purchase of one or more products, the buyer must, in the section The world of solosmedia (and / or Shop), select the desired one by clicking on the representative image.

4.3 Once in the product sheet, the buyer must click on the Add to cart button. Each click on the add cart button will add a unit of the relevant product to the cart.

4.4 Once the product selection has been completed, the user can view the summary by clicking on the eshop symbol at the top right (desktop view) or by following the links to the cart in the appropriate confirmation banners. In the Cart section it will be possible to change the quantity of units ordered for each paper and virtual product or delete the product from the Cart.

By clicking on Proceed with the order, the “order form” or check out will appear, which the buyer must fill in with their billing information and possibly specify a different shipping address.
At this stage you can create an account for future purchases and to save your data.
The currently active purchase method provides for the possibility of paying by credit card. The transaction and payment data entry takes place via the Stripe platform.

4.6 Before placing the order, the user will be asked to carefully read and approve these General Conditions of Sale and to accept them specifically. To continue, click on PLACE ORDER and you will be redirected to the order summary page.

4.7 The user’s order constitutes a contractual proposal addressed directly to Musicians & Producers srls

4.8 Immediately after receiving the order, Musicians & Producers srls will send the user an e-mail of acceptance (“order confirmation e-mail”) which does not constitute acceptance of the order proposal; with this e-mail Musicians & Producers srls informs the buyer that it has received the order and has subjected it to a process of data verification and verification of the availability of the products contained therein.

4.9 The purchase contract is concluded only when the buyer receives an e-mail of acceptance of the order (“e-mail confirming shipment / order completed”) with which Musicians & Producers srls confirms the conclusion of the purchase, informing the buyer of the shipment of the products or of the access credentials to access the multimedia products

4.10The shipping confirmation e-mail contains a summary of the order and the legal information already contained in the order form.

4.11 The user can cancel his order, without being charged any costs, only before receiving the shipping confirmation e-mail.

4.12 The user can check the status of his order at any time by accessing the reserved area – MY ACCOUNT link at the top right next to the cart.

4.13 In the case of physical products, the purchase invoice will be included in the package and the buyer will receive it together with the goods. In the case of a virtual product, the invoice will be sent by email

5. Shipping

5.1. The Order will be shipped following receipt of payment by the Customer

5.2. The shipping costs of the Product or Products purchased are included within the item of the total purchase price.

5.3.The shipment of the goods takes place at the risk and peril of the purchaser, through third party couriers and forwarding agents, for whose fulfillment Musicians & Producers srls assumes no guarantee or liability.

5.4. Any responsibility of Musicians & Producers srls for any delivery delays attributable to any cause is excluded.

6. Payments, prices and costs

6.1. The price of the Products is that indicated on solosmedia.net at the time the order is sent by the Customer. Product prices include VAT and include shipping costs. The sale price including the expected shipping costs will be displayed in the summary form, before proceeding to checkout and payment.

6.2. Orders placed through solosmedia.net can be paid through the Stripe platform.

6.3 The Seller does not assume any liability and / or guarantee regarding the correct functioning of the Stripe platform service.

6.4.It is understood that any commissions charged by their credit institution for the management of the payment will be borne by the Customer

7. Promotions, rewards and discounts

7.1. Musicians & Producers srls has the right to assign discount coupons, prizes or launch promotional initiatives with the aim of promoting their products. The discount vouchers guarantee a reduction on the original sale price of the products in compliance with these Terms and Conditions, as well as the regulation of the related promotional initiative.

7.2. In such cases, the buyer, if the conditions exist, may make use of vouchers, prizes and promotions for the purpose of purchasing a Product, indicating the relevant identification code in the appropriate box, before proceeding to checkout. Once inserted, solosmedia.net will subtract the prize, discount or promotion from the total price. Multiple use of promotional codes or for Products not falling within the scope of the promotional initiative is not allowed. The promotional code cannot be used after checkout, except, if applicable, the applicability of the same for the purpose of purchasing a different Product, also included in the promotional initiative, for the relative period of validity.

8. Invoicing

8.1. The buyer can request an invoice by sending the billing information to ordini@solosmedia.net 

8.2. Musicians & Producers srls will promptly send the buyer, in electronic format, via e-mail to the address stated by the same at the time of registration on the Site, the invoice / tax documentation relating to the purchase made.

9. Right of withdrawal

9.1.

The right of withdrawal by the buyer is excluded, unless the same qualifies as a Consumer, pursuant to and for the purposes of Legislative Decree 206/2005 (Consumer Code). In the latter case, pursuant to art. 52 Consumer Code, the buyer can exercise the right of withdrawal within 14 days from receipt of the Product, by sending an email containing the Product identification code and the buyer’s data, to the address ordini@solosmedia.net or by registered letter with return receipt addressed to Musicians & Producers srls, Via Legnone 90, 20153 Milan. In any case, it is the Customer’s responsibility to return the Product, at his own expense, in the same conditions in which he received it, to the address that will be communicated by Musicians & Producers srls

9.2. Musicians & Producers srls reserves the right to reimburse the buyer the amount paid as consideration for the order, only after receiving the Product or Products being returned, and verifying their integrity. The reimbursement of the price can be excluded or limited by Musicians & Producers srls if the Product should be returned damaged or with physical alterations, wear and / or wear.

9.3. Once the Product has been received and its integrity has been ascertained, Musicians & Producers srls will refund – in the same payment methods used for online purchases – the price received, including shipping costs, within the next 14 days.

9.4. Pursuant to art. 59 of the Consumer Code, the right of withdrawal is in any case excluded for orders relating to products of an editorial nature in digital format (e-book).

10. Customer data and privacy protection

10.1.

In order to proceed with the possible registration of a user account, with the forwarding of the order and then at the conclusion of the contract, some personal data of the Customer are required through solosmedia.net. The same will be processed by Musicians & Producers srls, in compliance and in compliance with the current Privacy legislation (Privacy Code and EU Reg. 2016/679, so-called GDPR), as per the privacy policy provided to the buyer through solosmedia.net, in the version in force at the time of providing personal data. The buyer declares and guarantees that the data provided to Musicians & Producers srls during the registration process are correct and truthful.

10.2. The buyer may at any time update and / or modify their personal data provided to the Seller through the appropriate section of the solosmedia.net website. In any case, the changes will not affect orders already placed previously.

11. Force majeure causes

Musicians & Producers srls will not be liable in the event of total or partial non-fulfillment of the obligations set forth herein if such non-fulfillment is caused by unforeseeable events and / or natural events beyond its reasonable control, including but not limited to , catastrophic natural events, acts of terrorism, wars, popular uprisings, lack of electricity, general strike by public and / or private workers, restrictions on the viability of couriers and air connections, epidemics and pandemics.

12. Applicable law and dispute resolution.

Jurisdiction.

These General Conditions of Sale are governed by Italian law. In the event of disputes arising from the interpretation of these General Conditions between Musicians & Producers srls and one or more of its end users, they will be the responsibility of the Court of Milan.

13. Clauses

13.1 The headings of the clauses used here are to be considered purely indicative and have no effect on the identification of the content and interpretation of this contract

13.2 In the event that a clause or a part of a clause of these Terms and Conditions should be considered invalid because in contrast or contrary to a law, all the other clauses of this agreement or parts of the same clause will remain fully valid and effective.
